Most of the time, the clothes are just for cosmetic purposes which may or may not appear in a rendered cut scene.

Blizzard were dealing out day bans but quickly realized that that was a bit excessive for people that were just tweaking their character looks, and that a warning would be more appropriate since it's still in violation of the ToS.
